Reservation Terms and Conditions

Thank you for your reservation with Visitar Marbella. We look forward to hosting you. Our goal is to provide you with a comfortable and enjoyable stay.

Please understand that onsite personnel are not affiliated with Visitar Marbella and may not be willing to assist the guest. Please call Visitar Marbella for assistance and we will do our best to help you.

 

Our guests are guests of both Visitar Marbella and the residential building and community! Please show your respect for the community by conforming to the rules and policies listed below.

 

Please read and review this contract and contact Visitar Marbella immediately with any questions or concerns regarding your reservation.

 

This agreement confirms that the registered guest (“the Guest, Guest/s or You”), is renting from Visitar Marbella (“the Brand, Holding Company, SL”), and agrees to the rules, regulations and policies listed here and shall apply to all extensions of this agreement.

 

What is included

The apartment is fully furnished and equipped and includes linens, pillows, towels, TVs, hairdryer, iron, standard kitchen appliances, microwave, as well as cookware and tableware. Cleaning supplies, such as vacuum, mop and broom are also provided. A starter pack of basic supplies, such as tissues and toilet paper are provided but please note we are not a hotel and will not be able to provide additional personal items, toiletries, or towels. Rent also includes basic TV services, Wi-Fi and utilities.

Furnishings and floor plans may differ from pictures on advertisements. Apartments pictures may be representative; however, Visitar Marbella will provide you with the booked apartments with the described features. Specific views and unit numbers are not guaranteed unless specified in advertisement.

Maximum Occupancy

A surcharge will be applied if at any time the number of occupants residing in the unit exceeds the amount as follows:

  • Calle Ribera, Puerto Banus: 4 adults (no children)

  • Banana Beach, Playa El Cable: 6 people

  • Marañón Playa De La Fontanilla: 4 people

 

All Guests’ names (over 16) must be registered with Visitar Marbella. No other person may reside in the apartment without written consent from Visitar Marbella.

Internet/wireless connectivity

Visitar Marbella provide complimentary wireless and basic TV services for your convenience. If there are any problems accessing these services please contact us immediately if possible. Please note that internet and TV connectivity issues are outside of Visitar Marbella’ control. We will help to get any issues resolved as quickly as possible, but since this is a complimentary service there will not be any refunds for this free service.

 

Smoking Policy

There is NO SMOKING or use of other illegal substances anywhere in the building including balconies or in outdoor amenities such as gardens and pools. Guest is responsible for any damages incurred due to smoking in the apartment. Possible damages include but are not limited to, deodorizing of apartment and/or furnishings and excessive cleaning or repair of apartment and/or furnishings. See fee schedule below

 

Party/Noise Complaint Policy

There are to be absolutely NO PARTIES anywhere on the property. Please respect the residents in your building. To them this is home. Parties and noise complaints will be taken VERY seriously. If a noise complaint occurs, guest will be notified via email or phone. (Please note that phone calls are recorded.)

 

Visitar Marbella will send a staff member to apartment to verify complaint, warn guests of complaint and make a report on activities and number of occupants in the apartment. Guests in violation of occupancy limit or party rules may be removed from the apartment. If a second noise complaint is received after the initial warning, guest will be immediately removed from the property.

 

Guests evicted from property will have their reservation considered as cancelled by the guest and additional penalties may apply. If necessary, police will be called to deal with any eviction issues, inappropriate or lewd behaviour.

 

Pet Policy

No pets are allowed on premises at any time without prior authorisation. Fees apply to having pets on premises and many building have breed, size and quantity restriction. Please contact Visitar Marbella for more information. Please note the schedule below for pet fees and unauthorised pet penalties.

Inclement Weather Policy

Visitar Marbella does not provide compensation due to issues that are beyond our control such as inclement weather delays on arrival, power outages, etc.

No unregistered guests Policy

Allowing unregistered guests to stay at the property is against Andalusian law (please see "Required Documentation / Identification").

Any reports of unregistered guests residing at the property will be reported accordingly, with the lead Guest held responsible for any damages or costs incurred.

Required Documentation / Identification

According to the Tourism Law of Andalusia (May 2016) it is mandatory for holiday rental property owners to register ALL guests with the police. As such all guests over the age of 16 must register with Visitar Marbella and provide identity document details prior to arrival. No other person may reside in the property without written consent from Visitar Marbella.

  • Photocopy / Picture of National ID document such as Passport

 

Visitar Marbella may cancel the Guest stay if an adequate copy of the identification cannot be provided.

 

Arrival and Departure Policy

Check in is at 3pm and check out is at 11am. If an early check in or late check out is requested please contact Visitar Marbella and we will do our best to accommodate you if at all possible. See fee schedule below for fees related to early check in/late check out. If Guest does not depart on time, Visitar Marbella has the right to charge any fees pertaining to late check out.

 

All keys, remotes, and parking passes are to be returned upon completion of stay. See below for fees charged for unreturned such items.

Guests are responsible for all contents in the apartment from check-in until check out. Guests will be responsible for damage to any contents that occurs during their stay.

 

Damages and Breakages Policy

Guest must report any damages and/or breakages in a reasonably timely manner, well in-advance of vacating the property. Damages exceeding the security deposit amount must be paid with the excess due by the lead Guest. Failure to do so will result in further action, not limited to notifying the Guardia.

 

Cancellation Policy

If Guest wishes to cancel the reservation, refunds will be managed as follows:

 

Full refund for cancellations made within 48 hours of booking, if the check-in date is at least 14 days away. 50% refund for cancellations made at least 7 days before check-in. No refunds for cancellations made within 7 days of check-in.

Visitar Marbella may consider the reservation as cancelled by Guest if initial deposit cannot be collected within 24 hours of booking and/or if payment in full cannot be collected by due date. We will make every attempt to contact the guest before cancelling.

 

Visitar Marbella may also be entitled to cancel the Guest stay if house rules are broken during rental period.

Temporary Covid-19 Cancellation Policy

Taking into account the impact of COVID-19, we have decided to offer an additional and temporary cancellation right to the original cancellation policy. Where guests can prove that the cancellation is due to COVID-19 (see terms of proof below):

 

Postponement or cancellation prior to the check-in date

Postpone: If the guest wishes to postpone the booking agreement due to COVID restrictions (negative COVID test, cancelled flights), they may change the booking period to a new date that is within the same calendar year from the original check-in date (via email to contact@visitarmarbella.com) but subject to availability. If there is a higher difference in price for the new dates, the guest will need to cover for such costs so as to ensure Visitar Marbella is not negatively financially impacted.

 

Terminate: In case the guest wishes to terminate the booking, the guest may terminate the booking with 1 week notice without any charge and will be given full refund. After this only 50% refund will be applied.

 

Terms of Proof: The right to cancel or postpone the underlying agreement, either prior to or after the check-in date, due to COVID-19 only exists if the guest is able to prove that:

  • The government (either country of origin of the Guest or country of the Visitar Marbella stay) has issued any travel bans post booking which prevent tourism travel and therefore preventing the Guest to check-in on the agreed date, or,

  • If the government (either country of origin of the guest or country of the Visitar Marbella) has issued any travel guidelines due to which the Guest is forced to return to their home countries or to leave the country.

 

Please note that this additional right to cancel only exists in case the Guest is able to produce evidence of the governmental guidelines on the travel ban.

Payment Policy

Payments can be made via all major credit cards, PayPal or money transfer.

 

Guest is responsible for all taxes, including without limitations, any use and occupancy, corporate housing, hotel, or any similar or related tax.

 

Collections

Visitar Marbella may consider the reservation as cancelled by guest if the payment cannot be collected within 24 hours and/or if payment in full cannot be collected. We will make every attempt to contact the guest before cancelling. Reservations cancelled in this way will forfeit their payment.

 

Credit Approval/Public Records Check

By signing the Reservation Agreement Guest represents that S/He/They has no criminal history that reflects any of the following, including, but not limited to, prosecutions or convictions for: any crimes involving actual or potential physical harm to person(s) or property; sex or morals related crimes; crimes involving possession, manufacture, sale or delivery of any controlled substance, marijuana, drug paraphernalia, or weapons; fraud or financial crimes.

 

Some buildings require a public records check at the time of booking. Guest’s name and birthdate may be submitted to a basic public records search by request of the building owners. Only the results of the search, Guest(s) names, assigned apartment and reservation dates will be submitted to the building owners. No other information will be shared. Visitar Marbella reserves the right to cancel a reservation at the request of the building owners. In the event of this cancellation, Guest will be refunded in full.

 

Some reservations are subject to credit and background check by Visitar Marbella. If not approved, the reservation will be cancelled and Guest refunded in full. By signing this Reservation Agreement, Guests give Visitar Marbella authorization to verify the validity of all information given.

 

Overbooking Policy

Occasionally overbookings may occur. Visitar Marbella will do our best to relocate Guest to a comparable property. If no acceptable alternative is available, reservation will be cancelled and refunded in full.

 

Use of premises

The apartment and its associated common areas shall not be used for ANY unlawful or illegal purpose. The Guest agrees to keep the suite in a neat and orderly condition. No changes or additions can be made to the apartment, such as hanging pictures on the walls. The apartment is to be used for residential purposes only. No commercial, industrial, or retail activity can be conducted in the apartment. Visitar Marbella is not responsible for any amenities or services that are closed, out of service, or cannot be used for any reason, and there will be no refunds for such events.
 

Please respect the building regulations regarding opening and closing times of any amenities and or public areas.

By signing the Reservation agreement, Guest hereby agrees to comply with the Building’s Rules and or Regulations of the Building. If Guest does not comply with the Rules or Regulations Guest’s Reservation Agreement will be terminated, and to the extent allowed by law, Occupancy will be terminated, and no refund will be provided.

 

Liability

We suggest that Guest/s obtain their own renters’ insurance, and should provide Visitar Marbella with a copy of the insurance policy prior to taking occupancy of unit. In the event that guest fails to obtain insurance and provide proof of same, Guest indemnifies Visitar Marbella from all liability, losses or damages occurring in the apartment and to any losses incurred by Guest(s) for personal property in the apartment. Guest is responsible for all losses, injury or damages to any person or property caused by Guest(s). Guest is responsible for all furniture and apartment damages beyond normal wear and tear, and loss of furnishings, electronics, or housewares. To avoid erroneous blame, please inform Visitar Marbella immediately upon the discovery of any damage to property or furniture.

 

Policy for Airbnb, Booking.com, Expedia.com, VRBO and other Third Party Website Reservations

Guests who book through a Third Party Website, including but not limited to Airbnb, Hotels.com, Booking.com, Expedia and TripAdvisor will adhere to rules governing their reservation from those Third Party Websites.

 

In cases where policies or agreements in the Third Party Website contract conflict with the statements made in the Visitar Marbella Reservation Agreement, the policies in the Third Party Website agreement will supersede the statements made on the Visitar Marbella Agreement, including but not limited to Cancellation, Fee Arbitration and Changes to Reservation. The Guest agrees to settle all disputes and fees for violations to the rental contract promptly through the Third Party Website.

 

Please report and issues immediately by contacting Visitar Marbella. We will do our best to deal with them in a timely fashion. Generally our turnaround time is 24 business hours. For building maintenance issues we are subject to the availability of the building and maintenance staff.

Signing of Reservation Agreement Policy

Visitar Marbella may consider a reservation as cancelled by the Guest if the Reservation Agreement is not signed within 2 days (48 hours) of the date the reservation is made or before the arrival date, whichever range of dates is the shortest. Payment for the rental of a Visitar Marbella property demonstrates acknowledgement of, and agreement to the Reservation Policy Terms and Conditions.

 

This agreement authorises Visitar Marbella to charge rent, any delinquent payments for rent non-local / long distance telephone calls, pay-per-view movies, incidentals such as fold away bed fees, unreturned keys / access items, pool passes and damages beyond normal wear and tear, to the payment method used for the reservation.

 

​For the mutual convenience of the parties, it is understood and agreed that by making payment as requested, I (the Guest) shall have acknowledged and consented to all terms and conditions of this agreement, on behalf of myself and those in my party.

 

The date of this agreement is the date the reservation is made.
